However, this three part series is a &#8216;must listen to&#8217; and informative glimpse into our legal system, how it has been manipulated or ignored, but more importantly, how it can be used to our advantage.. Is it really a step forward that the UN has enumerated \u201crights\u201d in an International Covenant on Economic, Social and Cultural Rights and an International Covenant on Civil and Political Rights? What are the practical effects of Locke\u2019s and Rousseau\u2019s thought-exercise propounding that man is a blank slate? Were our rights <span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><a style=\"color: #ff6600; text-decoration: underline;\" href=\"https:\/\/www.theguardian.com\/politics\/2018\/feb\/22\/identity-id-cards-abolished-1952\" target=\"_blank\" rel=\"noopener noreferrer\">won for us<\/a><\/span><\/span>\u00a0by being\u00a0<span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><a style=\"color: #ff6600; text-decoration: underline;\" href=\"https:\/\/en.wikipedia.org\/wiki\/Harry_Willcock#Willcock_v._Muckle\" target=\"_blank\" rel=\"noopener noreferrer\">asserted<\/a><\/span><\/span>\u00a0by our forefathers\u00a0<em>against<\/em>\u00a0government, or are they graciously granted\u00a0<em>by<\/em>\u00a0government and then curtailed and withheld again by that same government with a supposedly heavy heart?<\/p>\n<p style=\"text-align: justify;\">How is it that the first time the phrase \u201chuman rights\u201d was weaponised as a slogan was by\u00a0<span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><a style=\"color: #ff6600; text-decoration: underline;\" href=\"https:\/\/www.newyorker.com\/magazine\/2015\/01\/26\/berlin-story\" target=\"_blank\" rel=\"noopener noreferrer\">sexual proclivity activists in the Weimar Republic<\/a><\/span><\/span>\u00a0organising as the \u201cHuman Rights League\u201d, a century and a half after the coining of the term by philosophers? Why can an Englishman eject an intruder from his home but a Continental must wait for the police to turn up and do it for him? Is it sheer coincidence that\u00a0<span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><a style=\"color: #ff6600; text-decoration: underline;\" href=\"https:\/\/magnacarta.cmp.uea.ac.uk\/read\/articles_of_barons\/Article_29\" target=\"_blank\" rel=\"noopener noreferrer\">Article 29 of Magna Carta 1215<\/a><\/span><\/span>\u00a0seems to have been subverted by the\u00a0<span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><a style=\"color: #ff6600; text-decoration: underline;\" href=\"https:\/\/www.humanrights.com\/course\/lesson\/articles-26-30\/read-article-29.html\" target=\"_blank\" rel=\"noopener noreferrer\">same-numbered article<\/a><\/span><\/span>\u00a0of the Universal Declaration of Human Rights 1948, the so-called Global Magna Carta?\u00a0Are rights truly about \u201c<span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><a style=\"color: #ff6600; text-decoration: underline;\" href=\"https:\/\/www.ukcolumn.org\/article\/in-pursuit-of-fairness\" target=\"_blank\" rel=\"noopener noreferrer\">fairness<\/a><\/span><\/span>\u201d or \u201c<span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><a style=\"color: #ff6600; text-decoration: underline;\" href=\"https:\/\/twitter.com\/kamalaharris\/status\/1322963321994289154\" target=\"_blank\" rel=\"noopener noreferrer\">equity<\/a><\/span><\/span>\u201d \u2014 or is that actually a swizz?<\/p>\n<p style=\"text-align: justify;\">Join us to hear why David Scott argues that the twentieth-century rights discourse has made us \u201cpart-time slaves\u201d; how \u201cYou can\u2019t interfere with me\u201d has degenerated into \u201cThe government\u00a0<em>must<\/em>\u00a0interfere with\u00a0<em>you<\/em>\u00a0because of\u00a0<em>my<\/em>\u00a0rights\u201d;\u00a0whether we even have a\u00a0<span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><a style=\"color: #ff6600; text-decoration: underline;\" href=\"https:\/\/www.youtube.com\/watch?v=x9wEAqdCVBE&amp;t=20m20s\" target=\"_blank\" rel=\"noopener noreferrer\">right to bodily integrity<\/a><\/span><\/span>\u00a0any more; how statutes as apparently innocuous as the\u00a0<span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><a style=\"color: #ff6600; text-decoration: underline;\" href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1888\/41\/pdfs\/ukpga_18880041_en.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Local Government Act 1888<\/a><\/span><\/span>\u00a0hive off rights from us to government; what it means when Continental judges \u201cset aside\u201d their national laws and constitution because of a treaty ratified by their government; and what the lawyerly trick of conflating rights with powers involves. There is no better time to be discussing these questions than in\u00a0<span style=\"color: #ff6600;\"><a style=\"color: #ff6600;\" href=\"https:\/\/www.ukcolumn.org\/article\/coronavirus-lockdown-regulations-expose-divided-kingdom\" target=\"_blank\" rel=\"noopener noreferrer\">2020<\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\">For an example of the thinking that we politely disagree with,\u00a0<span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><a style=\"color: #ff6600; text-decoration: underline;\" href=\"https:\/\/podcasts.apple.com\/nl\/podcast\/history-human-rights-sarah-irving-stonebraker-natasha\/id1524244491?i=1000494880451\" target=\"_blank\" rel=\"noopener noreferrer\">this recent podcast<\/a><\/span><\/span>\u00a0on human rights may also be of interest to our listeners as they consider our current episode: it goes into detail on the mediaeval Christian background of \u201cnatural rights\u201d but sadly skips over immunity from theft and harm, in its haste to assert equal entitlement to positive goods \u2014 thereby tragically forming the very\u00a0<em>pretext<\/em> for such theft and harm by modern governments.<\/p>\n<hr \/>\n<h2 style=\"text-align: left;\"><span style=\"color: #003366;\">Episode 4<\/span><\/h2>\n<h3 style=\"text-align: left;\">Self-government or the consent of the governed?<\/h3>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/w.soundcloud.com\/player\/?url=https%3A\/\/api.soundcloud.com\/tracks\/943503283&amp;color=%23ff5500&amp;auto_play=false&amp;hide_related=false&amp;show_comments=true&amp;show_user=true&amp;show_reposts=false&amp;show_teaser=true&amp;visual=true\" width=\"100%\" height=\"300\" frameborder=\"no\" scrolling=\"no\" data-mce-fragment=\"1\"><\/iframe><\/p>\n<p style=\"text-align: justify;\">One or other of these assumptions about democracy must be a sham if the other is valid. Either we are ruling ourselves, or someone else is ruling us, and one or other of these has to be the preferable model.<\/p>\n<p style=\"text-align: justify;\">Democracy has been elevated to the status of an object of worship in recent decades, particularly in the English-speaking countries and in the discourse of the European Union, but it is accused by some dissidents of being a god that failed. Why is it that Homo democraticus tolerates no end of blatant corruption and has no qualms about the tyranny of the 51% over the 49%, as long as he is allowed to &#8220;have his say&#8221; in tokenistic votes choosing between increasingly pre-cooked outcomes? Is an &#8220;undemocratic upper chamber&#8221; (the accusation slung at the House of Lords in recent decades) an outrage or an intentional safeguard? How does the degenerate standard of British rhetoric in the &#8220;democratic&#8221; 2020s, and the political tolerance of dissent, compare with that of forty years ago?<\/p>\n<p style=\"text-align: justify;\">Last episode, we considered several aspects of \u2014 and accurate names for \u2014 the distinction between immutable personal rights (immunities) and redefinable civil or civic rights (entitlements), and concluded that there was great tyrannical power in the deliberate obfuscation of these two fundamentally different categories. We now proceed further into the mirk and engage with the thinkers who have dared to question the axiomatic goal of democracy, considering seminal works by Hoppe, Hayek, Mises et al., Ferrara, Legutko, Barnett and Orb\u00e1n. Just as Episode 1, on constitutional design, inevitably &#8220;did God&#8221;, so this episode will surprise some by necessarily dwelling on economics and on the capture of thought-leadership channels, the media and academia, by a swelling government.
